1. Introduction

1.1 These Terms and Conditions set out the rules for using the Kacob online store and the conditions for concluding sales contracts through our website. By placing an order, the Customer accepts the following provisions, which apply to all transactions conducted online.

1.2 The meaning of terms used in these conditions can be found in article 23 (“Definitions”).

2. Acceptance of terms

2.1 By using the service or completing a purchase at Kacob, the Customer declares and confirms that: (a) they are an adult who has reached the age of 18; (b) they have full legal capacity necessary to enter into a binding sales contract; (c) they are not restricted by any legal impediments that would prevent entering into a contract with our store.

2.2 Kacob reserves the right to request written confirmation that you are indeed authorized to accept these terms.

2.3 You further guarantee that:

(a) you have not been convicted of crimes related to computer abuse or online activities; and
(b) you have not previously been excluded from using our services or accessing our online store.

2.4 Kacob reserves the right to restrict or deny you access to (parts of) the website if necessary to protect our services, other customers, or due to applicable laws.

2.5 By placing an order at Kacob, you confirm that:

(a) you have read, understood, and accepted these General Terms;
(b) your order is subject solely to these terms;
(c) no other arrangements apply except these terms; and
(d) you agree to comply with all obligations arising from these terms.

2.6 If you do not agree with these terms, please do not use our site or place orders.

2.7 Using certain features or completing a purchase may require your prior explicit acceptance of these terms.

2.8 By using our website or placing an order:

(b) you agree to our responsible use policy (see article 12).

By purchasing in our store, you declare that you use Kacob's services exclusively as a consumer for private purposes. In particular, this means that:

• You purchase products for your own use, not for business, professional purposes, or on behalf of third parties;
• You agree not to resell the purchased goods or use them for any commercial activity.

4. Prices and additional costs

4.1 All prices on the site Kacob prices are quoted in Polish zloty (PLN) and include the applicable Polish VAT (23%) and other required fees. Shipping costs are included in the product price unless otherwise indicated.

4.2 Note: If you place an order from outside Europe, additional import fees such as customs duties and local taxes may apply. These costs are solely borne by the customer.

If you have questions about possible import costs, we recommend contacting customer service or local customs authorities.

4.3 Kacob makes every effort to ensure that information, including prices and product descriptions, is accurate. In case of a pricing error, we will contact you as soon as possible. You then have the option to:

• order confirmation at the correct price; or
• order cancellation without costs.

4.4 In case of an obvious pricing error, we are not obliged to deliver the product at the incorrect price, even if you have received an order confirmation.

4.5 We reserve the right to change prices at any time. These changes do not apply to orders already confirmed.

5. Order and confirmation

5.1 After placing the order, it will be processed subject to availability. If available, you will receive an order confirmation by email.

5.2 A binding purchase agreement is concluded only after receiving the order confirmation.

5.3 If you ordered several products, they may be shipped separately.

5.4 Kacob may remove or change products in the offer without prior notice.

5.5 We may refuse or cancel the order in whole or in part, for example, in case of technical errors, pricing errors, or suspected fraud.

5.6 If we cancel the order after payment, we will refund the full amount using the same payment method.

6. Payment

6.1 Secure payment methods are available, such as Payment Card (Mastercard, Visa).

6.2 Kacob is not responsible for unauthorized use of the payment method by third parties.

6.3 By placing an order, you declare that you will not file unjustified chargebacks.

7. Delivery

7.1 We deliver the order to the address provided during the order process.

7.2 Estimated delivery time is approximate.

7.3 If delivery is not possible, the order will be canceled and refunded.

7.4 The risk of loss or damage passes to the customer upon delivery.

8. Order cancellation or modification

8.1 To cancel an order, contact us as soon as possible. We can only cancel orders before shipping.

8.2 Cancellations and returns If the order has already been shipped, it cannot be canceled but can be returned according to our Return Policy. In case of loss of the return shipment, the verification and refund process will be initiated immediately after the customer provides proof of parcel dispatch.

8.3 The ordering system operates automatically, so usually we cannot stop processing after payment.

9. Defective or damaged products

9.1 Products are not made to order.

9.2 Product information is provided "as is."

9.3 Photos are for illustrative purposes.

9.4 If you receive a defective product, contact us and attach photos.

9.5 After approval, you can send the product back.

9.6 Verification will be carried out upon receipt.

9.7 We will inform you of the outcome by email.

9.8 In case of a justified defect, we offer:

(a) product exchange; or
(b) full refund of payment.

9.9 If the product is not defective, we may refuse the return and charge administrative fees.

10. Right of return and refund

10.1 According to EU consumer law, every customer has the right to withdraw from the contract within 14 days. Kacob voluntarily extends this period to 30 days.

10.2 The right of return applies to all products, including sale items, as long as they are in an undamaged condition.

10.3 Return shipping costs are borne by the customer unless the product is defective or damaged.

10.4 Refunds are made after receiving and inspecting the goods.

10.5 The product must be:

• in original condition,
• with a set of labels and packaging,
• well secured.

10.6 If the product does not meet the return conditions, we may refuse a refund.

10.7 If everything is in order, the refund will be processed within 7 business days.

10.8 Refunds will be made after checking the shipment.

11. Discount codes and gift vouchers

11.1 Kacob offers discount codes or vouchers.

11.2 Codes can be entered on the payment page.

11.3 Only one code can be used.

11.4 Codes have no monetary value.

11.5 In case of underpayment, the difference can be paid by an available payment method.

12. Permitted use of the website

12.1 The site may only be used legally. Prohibited activities include:

(a) performing illegal activities;
(b) distributing malware or viruses;
(c) scraping or automatic data downloading;
(d) using bots;
(e) violating robots.txt;
(f) spam;
(g) using data to contact third parties;
(h) reverse engineering;
(i) creating competing products;
(j) reselling access;
(k) sharing access on corporate networks;
(l) modifying or copying site content.

12.2 You are responsible for damages resulting from rule violations.

12.3 You agree to report abuses.

16.4 Every attempt at sabotage is a serious violation.

16.5 We may block access and report the matter to authorities.

17. Limitation of liability

17.1 We are not liable for damages resulting, among others, from:

(a) third-party content;
(b) errors in information;
(c) differences in colors or descriptions;
(d) decisions made based on information from the site;
(e) site outages;
(f) delays and force majeure.

17.2 We are not liable for indirect damages, lost profits, reputational damage, or financial losses.

18. Disclaimer and indemnity

18.1 You agree to release Kacob from liability for damages resulting from breach of terms or improper use.

18.2 We may demand coverage of legal and administrative costs.

19. Force majeure

19.1 In case of force majeure lasting more than 7 days, we may terminate the contract.

19.2 Force majeure includes, among others: natural disasters, pandemics, power outages, strikes, cyberattacks.

20. Changes to terms

20.1 Terms may be changed at any time.

20.2 If you do not agree with the new terms, stop using the site.

20.3 In case of significant changes, we may ask for re-acceptance.

21. Breach of terms

21.1 In case of violations, we may:

(a) send a warning;
(b) temporarily block access;
(c) cancel orders;
(d) refuse payment;
(e) permanently block the account.

21.2 Circumventing blocks is prohibited.

22. Applicable law

These terms are governed by Polish law. Every consumer has the right to use out-of-court methods for complaint resolution and claim enforcement (e.g., via the ODR platform: http://ec.europa.eu/consumers/odr).
